Oppose the Freedom-Destroying Dietary Supplement Safety Act

for the text of this bill as posted on Senator McCain's website) introduced by Senator John McCain (R-Ariz.) on February 4, 2010 has little to do with safety and much to do with regulation and control. This bill is rather an attack on the nutritional supplement industry.

Nutritional supplements, up to now, have been somewhat protected from the long arm and nose of the federal government because they are classified as food. There are laws on the books that already protect consumers from misbranded, fraudulent, or contaminated products, food or otherwise. The McCain Supplement Act would change all that. By playing favorites and ignoring the hundreds of unsafe drugs that cause serious harm and even death on the market today, all FDA approved, the FDA would now be granted absolute authority to over-regulate the dietary supplement industry.

The bill would severely limit development of any products from newly discovered nutritional components through regulation; install an onerous registration system for dietary supplement manufacturers; impose a burdensome documentation process for sellers complete with monetary penalties for non-compliance; and develop an “Accepted Dietary Ingredients” list at the sole discretion of the Secretary, who also would have unlimited recall authority.

The very broadly written bill leaves much room for the government to interpret its own definitions for terms like “adulterated,” “misbranded,” and “reasonable probability.” It would even make mandatory the reporting of minor side effects, which is not required for even the worst FDA-approved drugs. A Pandora’s box of intended and unintended legal complications and government harassment of nutritional supplement manufacturers and sellers could very well be unleashed if this bill is passed.

Those who best have the consumers health and safety interests at heart are the consumers themselves.

It is big government who has a proven track record of not protecting the public. And it is big government who is seeking to take away yet another individual freedom, the right to choose one’s own treatment, whether it be for the common cold or cancer.
